Quick Introduction - To Our Story

Hello dear reader, let me share a story with you. Our story is one of greed, deception, villains, injustice and a constant struggle to consistently resist being thrown out onto the street, from our home. This was done by every deceptive opportunist, abusing the process of the Court, to become a weapon of injustice. A unscrupulous Estate Administrator and their lawyers, were willing to lie, cheat and steal, to enrich themselves. They were willing to throw us out onto the street and sell the property out from under us, to receive a free roughly million dollar payout. Our loss is their gain. Or so they thought.
I ask you. How far into the elusive “rabbit hole” would you go, to see that justice is done, how much of your wealth and or integrity would you sacrifice? We would found out our limits. This has been going on for over 2 years, with no clear end in sight. Justice is elusive.
We believe in simple, foundational truths - would not accept the irrational, and paid a heavy price for it. Our journey is one of 'Self Represented Litigants', or 'Pro Se Litigants'. Let me explain.
What people believe goes on in Courtrooms, because of T.V. Programming, is not what really happens. In T.V. World, a nefarious situation is perhaps discovered, is investigated, solutions found, villains captured and punished accordingly, justice achieved, all within 45 minutes. In reality, living through it is another experience entirely. When you have to make decisions, that have sever consequences, when your fate rests on choosing wisely or suffering greatly, there is a lot of pressure on doing or not doing. Everything matters all the time, it is exhausting. This is the real world of litigation as we found it - today in British Columbia.
Everyone, is eventually confronted, with moments that test not only our resolve, but also our commitment to truth, fairness, and justice. Most people never expect those moments to arrive in the form of a Courtroom, yet that is exactly where our journey has taken us. We are ordinary people who found ourselves navigating an extraordinarily complex legal system, not because we sought conflict, but because we believe the truth is something precious, is therefore worth defending / establishing.
At the center of our story is a farm, a home, and years of hard work. More importantly, it is about the principles that surround them years. We believe every person deserves a genuine opportunity to have their evidence heard, their arguments considered, and their case decided fairly on its merits. That belief has become the foundation of our determination to continue, despite the financial, emotional, and personal cost.
We tried the truth, it did not work out well for us, as you will learn. We tried hiring lawyers, that was a waste of time and resources, as you will learn. So we made the rational choice of saving the farm ourselves, becoming Self Represented Litigants.
Representing yourself in Court, is one of the greatest challenges an ordinary individual may face. Every affidavit must be researched, drafted, printed, filed, and served correctly. Every legal authority must be understood. Every procedural rule must be followed. Every hearing requires countless hours of preparation, often while balancing employment, family responsibilities, and the ordinary demands of a mundane life.
Unlike large organizations or well-funded litigants, there is no legal department, no team of associates, and no unlimited budget. There is only determination, persistence, and an unwavering belief that truth deserves to be heard. There is only you. You have to be mature.
Our case has required us to study legal principles that few people ever encounter. We have immersed ourselves in the law of trusts, equitable remedies, burdens of proof, property ownership, civil procedure, and centuries of common law jurisprudence. What began as an effort to defend one property has become an education in the legal system itself. Along the way, we have come to appreciate both the strengths of the justice system and the immense challenges faced by self-represented litigants who must learn an entirely new language simply to participate effectively. You have to learn how to defend yourself, before you may actually defend yourself. Nothing is certain.
Rather than allowing these pragmatic experiences / results to disappear into Court files, and be 'Memory Holed', we decided to catalog them, turn them into something that could help others. We are writing a book that tells our story honestly and respectfully while explaining the legal concepts we have learned along the way. It is intended to be more than a memoir. It will serve as an educational guide for ordinary people who may one day find themselves standing alone in a courtroom, attempting to comprehend legal principles that lawyers spend lifetimes / years studying.
The names have been changed, so we may freely tell our story, but the story is absolute true. Each chapter will combine storytelling with practical legal education. Readers will follow our journey while learning about 'Land Titles', 'Bare Legal Title', 'Beneficial Ownership', 'Trusts', equitable principles, burdens of proof, court procedure, legal ethics, and the responsibilities that accompany the Administration of Justice. We hope that by explaining these concepts in plain language, to share what we have learned, the book will empower others to better understand their own rights and responsibilities. Recent Land Title Claims, in Canada, bring into question. the previous sense of confidence in Land Ownership, that we have had. Our book helps to demystify some of these concepts, that may effect you. Uncertainty brings fear, comprehension is direction and action, to protect what is yours.
To make this project as transparent and collaborative as possible, we will publish one chapter online each week at no cost. Readers will be able to follow our progress, offer constructive feedback, and watch the book develop before the final manuscript is printed. Feedback is welcome, and encouraged. This approach allows anyone, who chooses to join us on this journey, to become part of the creative process. Revenue generated from those books, will be directed toward helping fund, the continuing legal proceedings and reducing the significant financial burden that litigation - to date - has imposed. The financial reality of litigation is difficult to overstate. Despite these challenges, we have chosen not to give up. We believe perseverance matters. We believe integrity matters. The truth matters. We believe that fairness is worth defending, even when doing so is difficult. Regardless of the eventual outcome, we want to know that we did everything within our ability to present our case honestly, respectfully, and completely.
This project is therefore about far more than one legal dispute. It is about preserving hope for ordinary people who believe that justice should not depend solely upon financial resources. It is about demonstrating that careful research, respectful advocacy, and unwavering determination still have a place within our legal system. It is about encouraging others not to lose heart when confronted by overwhelming obstacles.
